AstraZeneca has been sued for allegedly using false and misleading advertising to promote its cholesterol drug Crestor, the UK’s largest drug manufacturer has revealed.
AstraZeneca’s suit alleges that it was aware of the “false and misleading” claims that it sold Crestor as a prescription drug in the UK in 2001.
AstraZeneca was ordered to pay $1.6bn (£1.4bn) in damages to its shareholders, the suit alleges.
The suit alleges that AstraZeneca did not disclose the false and misleading claims to consumers, as a part of a settlement announced in November 2003.
The suit is based on an analysis of the advertising claims on the AstraZeneca website, which was not found to contain a list of drugs to which AstraZeneca was advertising Crestor.
The suit also alleges that AstraZeneca made the misleading claims, in particular the “false and misleading” that it presented to consumers as an “off-label” drug for the treatment of heart disease.
The suit also alleges that AstraZeneca had not disclosed the information, in particular the “off-label” label to patients, to AstraZeneca, according to the suit.
“The company failed to disclose the true medical information about Crestor that it received from its physicians and had never had a chance to consult with its doctors,” the suit alleges.
The suit also alleges that AstraZeneca’s marketing of the drug failed to include information about the potential risk of an increased incidence of heart attack and death following the development of the drug in the 1990s.
The suit also alleges that AstraZeneca’s marketing of Crestor had no reasonable basis in the information contained in the “off-label” label of the drug and the lack of an appropriate regulatory framework for such a claim.
